Lifetime Drain System Warranty

Warranty Coverage.
Subject to the terms and conditions set forth herein, the Company warrants all full drain system relining or full drain system replacements performed by the Company (“Covered Work”) to be free from defects in workmanship and materials for the lifetime of the residential structure in which the Covered Work is installed (the “Lifetime Warranty”).

Duration and Transferability.
This Lifetime Warranty applies for as long as the original residential structure remains in place and is transferable to subsequent property owners, provided that:

1. A valid and continuous Service Partnership Plan is maintained without lapse; and

2. Any subsequent property owner assumes and maintains the Service Partnership Plan at the time of transfer.

3. This Warranty and Covered Work shall be conditioned upon full payment of all outstanding invoices. Moreover, this Warranty and Covered Work shall be voidable by Company if it is determined that damage, malfunction, or performance issues arise from neglect, misuse, improper maintenance, or failure to comply with reasonable maintenance, said determination shall be made at the sole discretion of Company.

If the Service Partnership Plan is not maintained or assumed upon transfer, this Lifetime Warranty shall automatically convert to a twenty (20) year limited warranty, commencing from the original date of installation. The converted twenty (20) year warranty shall be non-transferable.

Transfer Requirements.
For the Lifetime Warranty to transfer to a new property owner, the new owner must enroll in and maintain the Company’s Service Partnership Plan. Failure to do so will void transferability and limit coverage as described above.

Exclusions

Improper Use and Abuse.
This warranty does not cover damage, failure, or defects caused by misuse, abuse, or improper operation of the drain system, including but not limited to the flushing or introduction of foreign objects or materials such as feminine hygiene products, toys, wipes, grease, or other items not intended for sanitary sewer systems.

Improper Maintenance Methods.
This warranty does not cover damage to drain linings caused by the use of mechanical sewer machines, cutting tools, augers, or similar equipment. All lined systems must be maintained using hydro-jetting only. Any damage resulting from the use of prohibited equipment voids warranty coverage for the affected area.

Acts of God.
This warranty does not cover damage or failure resulting from events beyond the Company’s control, including but not limited to fire, flood, earthquake, ground movement, soil shifting, or other natural or environmental conditions (“Acts of God”).

Structural Movement.
This warranty does not cover damage to piping, linings, or system integrity caused by foundation settlement, structural movement, or shifting of the building or soil, whether gradual or sudden.

Limitation of Remedy.
The Company’s sole obligation under this warranty shall be limited to repair or replacement of the Covered Work, at the Company’s discretion, subject to the terms herein. This warranty does not cover incidental or consequential damages.
